Welcome to MenuIQ
These Terms of Service ("Terms") govern your use of the MenuIQ mobile application ("App") developed by evergoods ("we," "us," or "our"). By downloading, installing, or using our App, you agree to be bound by these Terms.
1. Description of Service
MenuIQ is a menu analysis application that allows you to:
Scan and analyze restaurant menus for nutritional information
Receive AI-generated dietary recommendations and smart swaps
Filter menu items based on health goals and restrictions
Translate foreign menus and identify ingredients
Access nutritional estimates and health warnings
2. Acceptance of Terms
By using MenuIQ, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
3. Privacy and Data Collection
Local Storage Only
MenuIQ stores all your data locally on your device
We do not collect, store, or transmit your personal data to our servers
Your photos, preferences, and dietary data remain on your device
AI Processing
Menu analysis and nutritional estimates are generated using third-party AI services
Menu photos are processed temporarily for analysis purposes only
No photos or personal data are permanently stored by AI providers
Device Permissions
The App requests the following permissions:
Camera: To scan physical menus
Photo Library: To import existing menu photos
Location Services: To identify restaurants (optional)
4. User Responsibilities
You agree to:
Use the App for personal, non-commercial purposes only
Not attempt to reverse engineer or modify the App
Not use the App for any illegal or unauthorized purpose
Respect intellectual property rights of others
5. Content and Intellectual Property
Your Content
You retain ownership of all photos and content you submit to the App
You are responsible for ensuring you have the right to photograph menus
You may share your results at your discretion
Our Content
The App, including its design, features, and AI-generated analysis, is owned by evergoods
Nutritional and menu information is provided for informational purposes
You may not reproduce or distribute our proprietary content without permission
6. AI-Generated Content
Nutritional Information
AI-generated menu analysis and nutritional estimates are provided for informational purposes only
Information may not always be 100% accurate
Not Medical Advice: usage of the App does not constitute medical advice. Consult a healthcare professional for specific dietary needs.
We encourage users to verify information, especially regarding severe allergies
No Warranties
AI-generated content is provided "as is" without warranties of accuracy or completeness
We are not responsible for health decisions made based on AI-generated information
7. Disclaimers and Limitations
No Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy of AI-generated content
Limitation of Liability
To the maximum extent permitted by law, evergoods shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of use, or loss of profits, or health complications arising from use of the App.
8. App Store Terms
Apple App Store
If you downloaded the App from the Apple App Store, you acknowledge and agree that:
These Terms are between you and evergoods, not Apple
Apple is not responsible for the App or its content
Apple has no obligation to provide maintenance or support for the App
In case of App failure to conform to warranties, you may notify Apple for a refund
Apple is not responsible for addressing claims related to the App
Apple and its subsidiaries are third-party beneficiaries of these Terms
9. Updates and Changes
App Updates
We may update the App to improve functionality, security, or user experience
Updates may be required for continued use of the App
We are not obligated to provide updates but may do so at our discretion
Terms Updates
We may modify these Terms at any time
Significant changes will be communicated through the App or other reasonable means
Continued use of the App after changes constitutes acceptance of new Terms
10. Termination
By You
You may stop using the App at any time by deleting it from your device.
By Us
We may terminate or suspend access to the App immediately, without prior notice, if you breach these Terms.
Effect of Termination
Upon termination, your right to use the App ceases immediately. Data stored locally on your device will remain unless you delete the App.
